In her dissenting opinion, Supreme Court Justice Sonia Sotomayor argues that the court’s recent decision regarding how a suspect’s right to remain silent must be invoked effectively “turns Miranda upside down.” It used to be that a criminal suspect could simply remain silent in order to be shielded from forced interrogations – as granted by Miranda rights. Now they must actually break their silence in order to inform law enforcement that they wish to invoke their right to remain silent, reports the Associated Press.

Waiving your right to remain silent by being silent

In the case of Berghuis v. Thompkins 08-1470, Van Chester Thompkins claims he’d invoked his right to remain silent by remaining (mostly) silent. Mostly is the operative word because, like a consumer who found great rates on short term loans for bad credit, Thompkins couldn’t hold in his emotion. He let slip a damning “yes” when Michigan police asked him if he “prayed for forgiveness for shooting that boy (Samuel Morris),” referring to a January 10, 2000, murder in Southfield, Mich. An appeals court later threw out the confession and subsequent conviction, claiming that Thompkins’ generally uncommunicative state during his incarceration effectively invoked Miranda, which was ignored by law enforcement. However, the recent 5-4 ruling by the Supreme Court has overturned the appeals ruling.

The Supreme Court’s majority position on a suspect’s right to remain silent is similar to that of their view of invoking the Miranda right to a lawyer: the suspect must make a direct request. As Justice Anthony Kennedy puts it:

“Thompkins did not say that he wanted to remain silent or that he did not want to talk to police. Had he made either of these simple, unambiguous statements, he would have invoked his ‘right to cut off questioning.’ Here he did neither, so he did not invoke his right to remain silent.”

Presuming a suspect has waived their rights: murky territory?

Justice Sotomayor writes in her dissent to the majority opinion that the concept of requiring a suspect to speak out for their right to remain silent is at best counter-intuitive. At worst, she writes, this places suspects in a position where it can be easily assumed that are waiving their Miranda rights “even if they have given no clear expression of their intent to do so.” This, claims Justice Sotomayor, has “no basis in Miranda or our subsequent cases and are inconsistent with the fair-trial principles on which those precedents are grounded.”

For the most part, Thompkins was uncommunicative, save for an occasional “yes,” “no” or “I don’t know.” Is that, as well as some head-nodding and the “yes” statement after the prayer question, enough to indicate that a suspect is waiving his Miranda rights? Is the Supreme Court on the money here, or is their ruling too presumptuous? And do you agree or disagree with the path the Supreme Court has taken of late regarding the rights of suspects and criminals?

Small businesses showing no signs of current incentives to expand and grow

The National Federation of Independent Business (NFIB) compiles monthly and quarterly statistics on small businesses in the United States. Some of the areas covered in their “Small Business Economic Survey” include projected business expansion, earnings changes, sales changes and expectations, price estimates and changes, just to name a few.

The NFIB states that its federation includes some 350,000 members. Conducted among member businesses, the federation’s May 2010 “NFIB Small Business Economic Trends” survey discovered the following very interesting facts.

Small businesses report higher earnings

Small business earnings for the first quarter of 2010 have increased 9 percent, and up 12 percent from the end of the first quarter of 2009. The reason small businesses are experiencing higher earnings for April 2010 may be due to a rebound in the economy, but it still is too early to say whether this is the case.

Small business sales are rebounding

Small business sales peaked in late 2005, before the U.S. housing bubble burst. At this peak, sales for small businesses were at 15 percent. By early 2007, sales dropped to 5 percent. In January of 2008 that number dropped to -8 percent, and later dropped to -31 percent in mid 2009.

Since hitting that bottom, small business sales in the United States have risen. At last, sales were reported at -15 percent as of the first quarter of 2010, which is 30 percent below the 2005 peak of 15 percent. This 2005 number was taken before the beginning of the fallout of the housing bubble during that same year, and before the corporate banking derivatives in the autumn of 2008. Sales expectations have been in negative territory for 23 of the last 28 months, from January of 2008 to April of 2010.

In June of 2008, small business prices peaked at 32 percent. During the first quarter of 2009, small business prices reached a bottom of -25 percent. These prices declined for more than six months until early 2009. These statistics show that many small businesses, due to low sales, have had to lower prices to move inventory, which means that price deflation is occurring for many small businesses in the U.S. economy for over part of the past two years.

Small businesses borrowing less

The number of small business owners borrowing at least every three months hit its peak in April of 2006 at 40 percent. One year later, that number had dropped three percentage points to 37 percent. By the end of the first quarter of 2009, the percentage borrowing every three months had dropped seven points to 33 percent, and by April 2010, it had dropped a total of nine percentage points from its peak of 40 percent in 2006. This shows that small businesses, which are over 95 percent of the companies in the United States, are cutting back on expansion plans and, therefore, are not hiring as many new employees.

The ‘Citizen Consumers’ are the key

Capital expenditures by small businesses hit its peak in March of 2005 at 36 percent of the businesses surveyed, with capital expenditures hitting a low of 17 percent twice in December of 2008 and June of 2009. In April of 2010, it climbed just above the low at 19 percent. This shows that banks are lending less, partially due to the current banking crisis.

Also included is the fact that citizen consumers are significantly cutting back on discretionary spending and buying expensive new durable goods, if absolutely necessary. This is partially due to fears of the weak economy and losing their jobs. Many are using installment loans online to fund some purchases. And it is the U.S. consumer economy (which is over 75% of our nations GDP) that drives small business growth and expansion. It is the central factor that is contributing to the weakness in the current U.S. economy, which is clearly shown in the survey conducted by the National Federation of Independent Business.

Google is the nearly indisputable king of internet searches; last month alone, it claimed 72.11 percent of all searches in the U.S., according to HitWise. It makes sense, then, that Google would be trying to break into China, where the number of internet users exceeds the entire population of the U.S., according to the McKinsey Quarterly. Google initially censored many search results in order to comply with the government in China – blocking results about democracy, pay day loans, and Tienanmen Square. However, it appears that Google and China have reached an impasse in negotiations about censorship, and google.cn, the Chinese-based portal for Google will be shutting down.

Google.cn, the Google China web site, started in 2005. Originally, Google had agreed to censor search results in China to meet with the Chinese government’s requirements. Google took some very heated opposition to this move, but the proposition of getting their “foot in the door” to the very large Chinese market encouraged Google to work with the requirements of the government in China. There were some that accused Google, a very public supporter of net neutrality of putting their principles on the back shelf by agreeing to censor their results. The disagreement between Google and China

After the initial anger about Google censoring its search results to meet with China’s government regulations died down, things remained fairly quiet until January of this year. History of internet censorship in China

The government in China, for the most part, appears to be very unconcerned about Google’s decision to remove its censored search engine. This is, in part, because China has a fairly well-developed system of internet censorship that they have been monitoring and using for years. Known as the “great Firewall,” there is a massive no-access blockage to many web sites available online.

Many popular web sites, such as YouTube and Wikipedia, are also heavily restricted based on certain topics. China also requires internet users to provide personal information to log onto the internet in Internet cafes, where most internet users in China log on. This massive effort of information control is known as the “Golden Shield Project.” Many U.S. companies, such as Google, have altered the way they do business in China in order to work with their huge population and growing economic power.

What Google will do with China

Now that Google is “most likely” shutting down its Google.cn operations, internet users in China will most likely not be able to access Google.com. Though they will be effectively cutting themselves out of a very large market, Google’s handling of the government in China is just the latest of a long string of U.S. Companies clashing with the Chinese government. Google has stated that it hopes users in China will continue to use Google.com, though in reality, Google will most likely lose the market share available in China.
