<p>A newly enacted law makes it more difficult for debtors to garnish Social Security benefits. Banks cannot garnish any benefit payments like Social Security or disability unless there are two months of benefit payments, which is not incredibly likely to happen. However, the new rule only applies to banks.</p>
<h2>Government benefits under new protections</h2>
<p>The Department of the Treasury and other government agencies have changed a key rule concerning debt collection and recipients of federal benefits including Social Security, disability or other federal benefit payments, according to CNN. Banks are prevent from garnishing or taking money out of the accounts of people who are recipients of government benefit payments, unless the account has at least two months of benefits sitting in it. However, since many people who depend on government benefits do not always have that much in savings, that means that withdrawing funds for overdraft or other account fees may become a bit more tricky. Bank fees, including checking account fees and overdraft fees, have not been decreasing with the recession in the slightest, according to WalletPop, and Americans are expected to pay at least $38 billion in fees for 2011.</p>
<h3>Slight change for creditors</h3>
<p>Creditors, on the other hand, can still garnish government benefits. However, the rule for creditors changed slightly. Any creditor has to obtain a court judgement which allows them to garnish income before they can start extracting payments for past due balances. Whomever someone owes for credit cards, same day loans or <a title="installment loans" href="https://personalmoneynetwork.com">installment loans</a>, the creditor has to get the go-ahead from a court to do it. Before the funds can be accessed, though, a creditor has to determine which funds technically came from government benefits, whereas they previously did not have to. Government, on the other hand, can garnish anyone&#8217;s benefit payments if that person owes the government money.</p>
<h3>Social Security checks phasing out</h3>
<p>Soon, Social Security checks will be an anachronism, as the Social Security Administration is phasing out paper checks in favor of direct deposit, according to USA Today. For those recipients that don&#8217;t have bank accounts, the SSA will furnish them with a prepaid debit card in a partnership with Comerica bank. Currently, about 85 percent of Social Security recipients already receive their benefits through direct deposit. Each direct deposit transaction costs the federal government about 10 cents to complete. Each paper check written out and mailed costs about $1. The government issues about 120 million checks every year, and switching to a paperless system will save taxpayers over $100 million per year.</p>

Considering the relatively small dollar amount of these <a title="instant payday loans" href="https://personalmoneynetwork.com">instant payday loans</a>, the fee generally doesn&#8217;t break the bank. However, the 2011 NFL lockout has given rise to high-dollar variation of such loans, which the media has dubbed “lockout loans,” reports Yahoo! Sports. Players without paychecks because of the labor dispute who find themselves in financial distress are being solicited by lending agents with offers.</p>
<h2>Lockout loans: When 36 percent APR is dangerous</h2>
<p>While a 36 percent APR attached to consumer same day loan of $300 or $400 produces too little revenue for a lender to operate, NFL lockout loans for more than $60,000 at as much as 36 percent APR generate a lot of interest very quickly. Yet players from at least 16 NFL teams have already applied for such large-scale instant payday loans, writes Yahoo! Sports.</p>
<p>The NFL Players Association lockout fund has helped some players, but clearly the response to high-risk lockout loans indicates that some players haven&#8217;t curbed their extravagant lifestyles in the absence of their paychecks. The NFLPA <a href="http://personalmoneystore.com/moneyblog/2011/03/15/personal-finance-nfl-players-lockout/">advised players to save</a> at least three game checks from the previous season in anticipation of the 2011 lockout, but insiders report that the advice may not have been heeded. In addition, the NFLPA has urged players to refinance their homes, fly coach and pursue moneymaking opportunities like autograph signings and speaking engagements in this extended off-season, writes MSNBC.</p>
<h3>Why do NFL players have money problems?</h3>
<p>Sports psychologists suggest that star athletes are surrounded by enablers from a relatively young age. By the time players reach the professional ranks, it is not uncommon for them to lack real world financial knowledge, as they&#8217;ve never had to take responsibility for such things. Throwing millions of dollars at someone who may have grown up poor can also open the door to myriad temptations. This is perhaps why as many as 80 percent of retired NFL players have declared bankruptcy, according to a Sports Illustrated estimate. MSNBC indicates that as many as 380 of the NFL&#8217;s 1,700 players live from paycheck to paycheck, even though the average NFL annual salary in 2010 was $1.87 million. The rookie average was $320,000, but after taxes and agents, money problems can occur if players aren&#8217;t careful.</p>
<h3>A dissenting voice in support of lockout loans</h3>
<p>Sherard Rogers, a financial adviser to a number of NFL athletes, told Yahoo! Sports that lockout loans are a legitimate product that meets player demand. While franchises will endure, players who live to spend can run into trouble.</p>
<blockquote><p>&#8220;Every NFL team was valued at over $1 billion, so they can weather the storm of a lockout. But could players if there weren’t resources to cover this short-term labor dispute?&#8221; asked Rogers. &#8220;The key is to figure out how to solve the short-term liquidity issue and put the pieces in place to ensure they don’t have this liquidity issue again.&#8221;</p></blockquote>

<p>A recent report by the Government Accountability Office advises that consumers may want to think twice about entering into credit card debt protection plans. Such plans usually offer insurance against missed payments and so forth and seem like a good idea. However, it may benefit the card companies more than customers.</p>
<h2>Debt protection plans benefit card companies</h2>
<p>Credit card companies currently offer their customers dept protection plans, which the Government Accountability Office asserts is a beneficial arrangement, but mostly for the card companies. Essentially, if card carriers want to guard themselves against a possible default or missed payment, they can enroll in a debt protection insurance plan. The card holder pays a monthly fee, which is usually 85 cents to more than $1 per $100 of balance carried, according to Marlys Harris&#8217; blog on CBS MoneyWatch. At $1 per $100, a $2500 balance generates about $300 in enrollment fees per year. Those debt protection fees added up to $2.4 billion in revenue for the credit card companies in 2009, according to the Wall Street Journal.</p>
<h3>Few claims paid</h3>
<p>From that $2.4 billion in revenue, card issuers only paid about $518 million in benefits to people who filed a claim and only about 5.3 percent of people who filed a claim and maintained a balance had their claim paid by the credit card company. That revenue was about 55 percent profit, and a further 24 percent went to administrative costs. The 21 percent of revenue that was paid out is far less than automotive and life insurance companies pay. A person could conceivably be better off using <a title="instant payday loans" href="https://personalmoneynetwork.com">instant payday loans</a> instead of credit cards with debt protection insurance, in that most payday loans get paid off all at once.</p>
<h3>Bank fees hard to get clarified</h3>
<p>A survey by the United States Public Interest Research Group, a consortium of public interest groups from all 50 states, found that less than 40 percent of 392 surveyed banks and credit unions would fully comply with the Truth in Savings Act when asked to provide a list of all the fees the bank charges consumers, according to Reuters. Upon request the institution should be able to produce a fee schedule that lists account service fees, account closure fees, ATM fees and other fees such as a stop payment fee, bounced check or check processing fee. Some complied after multiple requests, and 45 percent refused to comply at all.</p>

<p>The recession is definitely over for banks that got bailout loans from the taxpayers, and the bailout is now paying dividends. The portion of the Troubled Asset Relief Program that lent funds to banks with bad assets has made a profit, as huge banks and Wall Street firms are very profitable again. Relief programs for the housing industry have not been so successful.</p>
<h2>Loans from the TARP program were good investments</h2>
<p>The <a title="installment loans" href="https://personalmoneynetwork.com">installment loans</a> from the taxpayers to huge banks and investment firms under the Troubled Asset Relief Program were certainly a cause of controversy. However, according to CNN, the Department of the Treasury has reported that loans to banks and other entities in the financial industry have resulted in a $6 billion profit, which may grow to a $20 billion profit by the time all loans are repaid. TARP had $700 billion, and $432 billion has been spent.</p>
<h3>Mortgage modification program cut</h3>
<p>The federal mortgage modification programs have not been as successful as the government hoped they would be. As a result, the Home Affordable Modification Program has wound up on the chopping block, according to MSNBC. House Republicans were able to pass a bill that would terminate HAMP, but it may be a symbolic gesture, as a narrowly Democrat-controlled Senate and the Democrat President may not be as amenable to cutting the program. The program has been deemed a failure, as it has a success rate of less than 50 percent in modifying mortgages. Other mortgage relief programs are being targeted for elimination, but eliminating such programs would likely also be symbolic. Senate Democrats and the President may not be willing to cut the lifeline to troubled homeowners regardless of whether the programs don&#8217;t keep many from having to get same day loans and move out of underwater homes.</p>
<h3>Wall Street feeling better about itself</h3>
<p>A recent survey, according to Reuters, revealed that CEOs at large corporations were feeling better about the overall economy and were more willing to hire and try to expand their companies. Of the 142 CEOs that responded to the survey by the Business Roundtable, a trade organization for Chief Executive Officers at major corporations, more than half said they were going to start hiring people in the next year. If hiring at large firms picks up, that provides a boost to the middle class.</p>

The <a href="http://personalmoneystore.com/moneyblog/2011/03/29/dodd-frank-3-billion-gao/">GAO</a> suggest that the Dodd-Frank Act and other FDIC changes in recent months may increase traditional financial institutions&#8217; willingness to offer same day loans, but the results may not be what banks expect:</p>
<blockquote><p>&#8220;Recent statutory and regulatory changes and FDIC initiatives may encourage more institutions to offer small-dollar loan alternatives to payday loans or expand their availability, but many consumers may still chose to use payday loans for their wide availability and relative lack of eligibility,&#8221; says the GAO report.</p></blockquote>
<p>A two-year FDIC pilot program illustrated that without the involvement of charitable organizations or government subsidies, banks and credit unions have been unable to popularize payday loan alternatives. Extensive underwriting requirements also tended to exclude the customer base that most wanted access to personal loans.</p>
<h3>Same day loans will not exclude you from a government job</h3>
<p>The notion that taking out same day loans is harmful to one&#8217;s financial reputation is disproved in the Government Accountability Office report. Federal agencies like the Department of Homeland Security, Transportation Security Administration and even the Federal Bureau of Investigations put applicants through an intense employment screening process that includes a thorough financial history. Credit reports are run and other financial evaluation tools are used.</p>
<p>According to the GAO, screening agencies stressed that whether or not applicants to high security clearance positions had used <a title="short term loans" href="https://personalmoneynetwork.com">short term loans</a> was not a determining factor in the hiring process. The presence of risky patterns of financial behavior is important, however, which underscores the important of financial responsibility – for government employees and consumers in general. If banks and credit unions could ever free themselves from the policy maze and judge same day loan applicants over a more broad range of financial responsibility, perhaps the institutions could sell personal loans directly to consumers.</p>

<p>The Securities and Exchange and Commission has slapped two <a title="online payday loans" href="https://personalmoneynetwork.com">online payday loans</a> lending companies owned by a single man with fraud suits. John Scott Clark, of Utah, is being sued by the SEC for allegedly running a Ponzi scheme with two online financial services companies. He has allegedly bilked more than 120 investors out of millions.</p>
<h2>SEC slaps online lending companies with fraud suit</h2>
<p>The owner of two companies involved in lending payday loans online has been sued by the Securities and Exchange Commission for running a multimillion-dollar Ponzi scheme. The SEC sued John Scott Clark, of Cache County, Utah, for defrauding more than 120 investors over a period of five years in return for  investing capital into two businesses that he owned, Impact Cash LLC and  Impact Payment Systems LLC, according to the Salt Lake Tribune. Clark allegedly recruited investors by promising an average return of 80 percent in exchange for capital, which he allegedly said would be used to fund payday loans to reliable customers. Clark was allegedly recruiting investors from March of 2006 to September 2010 and was able to secure more than $47 million from the investors he convinced to join the operation, according to the Credit Union Times.</p>
<h3>Clark accused of funding Mercedes habit with investor funds</h3>
<p>Clark would gain the confidence of investors and allegedly use new investment funds to pay dividends to initial investors and fund his lifestyle, according to Deseret News. Clark supposedly purchased three Mercedes-Benz cars, a 1963 Chevrolet Corvette, installed a home theater system in his home that cost $25,000 and also purchased lavish home furnishings. Some of his investors were growing suspicious by 2009 and asked Clark to sell their stake in his companies and turn the proceeds over, which he refused to do. Eventually, the SEC became involved, slapping Clark with a lawsuit alleging five different violations of the Securities Act. A Federal judge has placed both Impact companies into receivership and frozen the same day loans lending companies, according to the Wall Street Journal.</p>
<h3>One bad apple</h3>
<p>Online payday lenders are thought by some to be a nest of vipers. That is far from the case, but transactions that are completed fairly and honestly do not go widely reported. Still, customers and investors should be careful who they deal with in financial matters. Organizations like the Better Business Bureau exist for a reason. An informed consumer will always be in a position to make a better decision, and something that sounds too good to be true usually is.</p>

<p>Nationwide mortgage rates are creeping up despite dismal sales and demand. Interest rates on major mortgage products have been rising steadily for the past few months, though the rates are still near record lows. The real estate industry is still embroiled in a quagmire involving <a title="foreclosures" href="https://personalmoneynetwork.com">foreclosures</a>, and demand is nearing an all time low.</p>
<h2>Cheap housing cannot stimulate much demand</h2>
<p>Even some of the cheapest real estate on record cannot seem to boost sales. Recent housing data revealed new home sales and existing home sales fell during February. Interest rates on mortgage rates are climbing since hitting near-record lows in the fall of 2010, according to USA Today. The nationwide average rate on 30-year, fixed-rate mortgages reached 4.81 percent on Thursday, March 24, an increase of 0.05 percent in a week. The average 15-year, fixed mortgage hit 4.04 percent. In November of 2010, the 30-year fixed was at 4.17 percent, and the 15-year fixed reached 3.97 percent, the lowest rates in decades.</p>
<h3>Legal quagmire still ongoing concerning foreclosures</h3>
<p>The legal dilemma regarding possibly fraudulent foreclosures initiated by rubber stamped paperwork, or &#8220;robo-signing,&#8221; is still far from a resolution. Major mortgage lenders practically handed out same day loans, rushing foreclosure paperwork without doing the due diligence. A major investigation was launched into the matter that involves all 50 state attorneys general and various federal agencies. Banks and mortgage lenders involved in the scandal are still struggling to secure a settlement with the states and the federal government, and some government agencies are looking to create their own settlement to bypass the process, according to Reuters.</p>
<h3>Lousy outlook for real estate</h3>
<p>Once the matter is settled, a flood of foreclosures will begin; thousands of pending foreclosures have been stalled because of the  crisis. Evicting thousands of people will likely boost the payday loans industry as former homeowners scramble for cash to cover moving expenses. The foreclosure crisis is expected to cost the banking industry  tens of billions, according to Fortune, regardless of any government  settlements or fines. Anyone who can get access to the credit to purchase a home will benefit from doing so sooner rather than later. Demand and sales are very low, and fewer new homes are being built. The foreclosure mess has only made things worse, and the housing industry isn&#8217;t going to recover until prospective buyers are able to purchase homes again.</p>

<p>The next customer perk to go on the chopping block at the nation&#8217;s largest banks is debit card rewards. JP Morgan Chase stopped offering debit card rewards to customers in February, and will stop giving rewards to debit card swiping customers entirely in July. The program was closed due to the ongoing battle over the pending cap on interchange fees.</p>
<h2>Banks contend they will be brought low with interchange fee cap</h2>
<p>The possible cap on interchange fees, or the fees banks charge merchants to transmit payment from debit purchases, has caused the nation&#8217;s largest banks to start curtailing customer rewards and incentives, such as free checking. The next casualty of the interchange fee battle is likely to be debit card rewards, according to Bloomberg. Leading the charge in cutting back on rewards for customers is JP Morgan Chase, which stopped offering enrollment into the debit card rewards program to new customers in February. Chase will stop offering rewards altogether on July 19, though any reward points that have been accrued by that point will still be honored. Consumers may eventually need same day loans to use their own money.</p>
<h3>Fees at ATM locations going up as well</h3>
<p>Another response to financial reform laws has been to raise fees for using automatic teller machines out of a bank&#8217;s network, according to MSNBC. JP Morgan Chase, the second largest bank in America, is currently testing $4 and $5 fees for customers who use Chase machines that aren&#8217;t Chase customers. The program is testing $4 fees in Texas and $5 fees in Illinois. All other states will retain the $3 fee for non-Chase customers, which is above the $2.33 national average. Chase customers will still pay only $2 per transaction at non-Chase ATMs, which is also above the $1.41 national average. Chase has the second largest ATM network in the nation. TD Bank and Citi bank are following suit, and Wells Fargo and Bank of America are likely to not be far behind. The idea of Chase, Bank of America and Wells Fargo having to run for <a title="installment loans" href="https://personalmoneynetwork.com">installment loans</a> because legislation prevents them from gouging customers is not likely to cause many people discomfort, but there is a catch.</p>
<h3>Credit unions would also suffer</h3>
<p>Merchants are charged interchange fees by for-profit banks and non-profit credit unions alike, according to Forbes, and that is why credit union trade groups such as the National Association of Federal Credit Unions, oppose the Durbin Amendment to the Dodd Frank Act. Credit unions and community banks are not as easily equipped to absorb the loss of revenue from interchange fees, which will be lowered to 12 cents per transaction from the current average of 44 under the current proposal by the Federal Reserve. Currently, bills are being introduced into the House of Representatives and Senate which would delay the Durbin Amendment from taking effect for two years, in order to study the possible fallout.</p>

<p>The Community Financial Services Association of America (CFSA), a national organization dedicated to the promotion of responsible regulation of the personal loans industry, has issued a press release that denounces aggressive debt collection practices that violate consumer rights, reports the Wall Street Journal. According to the newspaper, more than 5,000 arrest warrants were issued against defaulted borrowers last year in more than a third of U.S. states. The CFSA is lobbying to eliminate this legal practice as used by rogue <a title="debt collectors" href="https://personalmoneynetwork.com">debt collectors</a>, which the organization considers an affront to consumers in dire financial straits.</p>
<h2>The industry stands up for same day loan customers</h2>
<p>CFSA board chair D. Lynn DeVault envisions a U.S. same day loans industry that will stand together to put unscrupulous debt collectors out of business.</p>
<blockquote><p>“It is simply wrong to pursue criminal complaints against consumers who have defaulted on personal debt,” said DeVault. “Lenders should be <a href="http://personalmoneystore.com/moneyblog/2011/03/17/debt-collection-arrest-warrants/">working with their customers</a> to figure out a solution. Our members offer borrowers an extended payment plan at no extra cost to the borrower and adhere to CFSA Best Practices, which prohibit any criminal recourse.”</p></blockquote>
<p>A key provision of the CFSA&#8217;s Best Practices is that no member personal loans company will threaten borrowers or pursue criminal action against them in relation to a customer&#8217;s check or account going unpaid.</p>
<blockquote><p>“We stand ready to work with regulators and policymakers to block rogue lenders and debt collectors from pursuing criminal complaints,” said DeVault.</p></blockquote>
<h3>Washington State House bill requires debt collectors to provide proof</h3>
<p>In early March, the Washington state House of Representatives unanimously passed a bill that would require debt collectors to provide indisputable proof that a borrower has been notified of a potential lawsuit before an arrest warrant can be issued. The bill is expected to pass the state Senate and meet the approval of Gov. Christine Gregoire. A trade group representing debt collectors has also come out in support of the legislation in light of the fact that some rogue debt collectors have abused existing laws.</p>
<p>Nationally, the Federal Trade Commission is currently investigating aggressive debt collection practices.</p>

<p>Customers of JP Morgan Chase may have additional restrictions placed upon their debit card usage soon. The third-largest bank in the U.S. may cap debit card transactions to $50 or $100 at a time, even if the card is run as credit, says an anonymous insider. Blame it on the rising interchange fees banks charge retailers per transaction, reports Chicago Breaking Business.</p>
<h2>Interchange fees: Why retailers demand minimum debit transactions</h2>
<p>On average, banks charge retailers 44 cents for every debit card transaction, as an interchange fee that the bank shares with its financial partners. Federal Reserve data indicates that interchange fees from retail debit card transactions amounted to $16 billion in 2009. Wall Street reforms introduced by the Obama administration will curb the amount of such fees. Interchange fees may be capped at only 12 cents per debit card transaction, beginning July 2011.</p>
<h3>Passing the expense on to customers</h3>
<p>JP Morgan Chase and other banks aren&#8217;t enamored with this. Chase estimates it would cost over $1 billion per year. Joe Price, president of consumer banking at Bank of America, said that a 12-cent cap would not fairly compensate the bank for infrastructure costs. Banks would increase consumer costs for debit cards and other services to compensate.</p>
<p>One innovative way <a href="http://personalmoneystore.com/moneyblog/2011/02/07/chase-servicemembers-loans/">Chase would recoup costs</a> is to charge customers $3 monthly for having a debit card, and $15 more each month to maintain checking accounts. Match this with Chase&#8217;s defunct debt card rewards program and customers are left out in the cold.</p>
<h3>Hate ATM fees? Avoid them!</h3>
<p>There are a number of ways that banking customers can avoid excessive debit card/ATM fees. CBS Moneywatch and Personal Money Market have some ideas that consumers try as many of the following as possible to beat the bank.</p>
<h3>Open a brokerage checking account</h3>
<p>Brokerage checking accounts are generally high-yield. Not only that, but accounts at some brokerage houses rebate customer debit card transaction fees at the end of the month if a separate brokerage account is maintained.</p>
<h3>Try online banking and apps</h3>
<p>Consider online banking. Some charge no ATM fees at all, while others will completely reimburse customers for a limited number of out-of-network ATM fees each month. Keep in mind that maintaining a minimum balance in the account is often required at online banks.</p>
<p>Remember that there are also numerous free iPhone and Android applications that make finding an in-network ATM a snap. Who wants to pay $3 every time cash is needed?</p>
<h3>Get cash back at the store</h3>
<p>When the option is available, try to use your debit card for cash back when you make purchases. There is typically no transaction fee involved, although the amount of cash you can withdraw may top out at around $60.</p>

<p>There are plenty of financial experts who claim that if you&#8217;re in a situation where you need same day loans, there are consumer payday loan alternatives offered by banks and credit unions that are less expensive. However, as sources like <strong>ConsumerAffairs.com</strong> indicate, many of these bank and credit union quick loans available the same day are burdened by their own high fee structure. A recent study by the National Consumer Law Center (NCLC) reviewed hundreds of different types of small, same day loans that banks hype as payday loan alternatives and found them to be less than desirable.</p>
<h2>Payday loan alternatives: Shouldn&#8217;t they be cheaper?</h2>
<p>Setting aside the much-referenced academic study that shows that <a href="http://personalmoneystore.com/moneyblog/2009/11/06/payday-loans-alternative-lmi/">same day loans aren&#8217;t actually expensive</a>, the truth is that when it comes to payday loan alternatives, most do not improve upon the model they&#8217;re designed to replace. Lauren Saunders of the NCLC stated in the report that &#8220;too many providers of so-called payday loan alternatives hit consumers with some of the same onerous provisions that predatory lenders use to saddle unwary and vulnerable borrowers with loans they can&#8217;t afford to repay.&#8221;</p>
<p>Report co-author Leah Plunkett agrees, stating that while &#8220;Many genuine payday alternatives are in the market,&#8221; many of the alternatives are worse financially than payday loans. Specifically, Plunkett references check account <a title="cash advances" href="https://personalmoneynetwork.com">cash advances</a> from such big banks as Wells Fargo Bank, U.S. Bank and Fifth Third Bank. &#8220;They are payday loans, plain and simple: triple digit loans repaid on the next payday.&#8221; That&#8217;s hardly an improvement over the already popular same day loan product.</p>
<h3>Credit unions offer quick loans the same day, but at what discount?</h3>
<p>The NCLC study found one credit union in California – Kinecta Federal – that exploited loopholes in lending laws in order to profit as much as possible while still being able to suggest they&#8217;re one of the cheaper payday loan alternatives. Kinecta offers a 14-day loan with an APR of at least 362 percent, a rate which is comparable to some same day loan rates, but not cheaper. Other credit unions offer what amounts to expensive payday loan alternatives via a third party lender, E-AccessLoan.com.</p>
<h3>What should payday loan alternatives do for consumers?</h3>
<p>&#8220;Payday loan alternatives that help consumers must be repayable affordably and over time, so that hard-pressed borrowers who need short-term help can climb out of debt rather than get trapped in it,&#8221; said Saunders. Unfortunately, many of the payday loan alternatives banks and credit unions offer are not their as an offer of goodwill. They want to profit from consumers as much as the law will allow.</p>

Apps currently in the market should work on Google TV if they do not require phone-specific hardware.</p>
