<p>A new product to get celebrity endorsements are credit and debit cards. Celebrity debit cards work like a typical card, except that because a celebrity endorses it, the fees are higher than normal. A person would be better off with a cash advance than some of these cards.</p>
<h2>Consumers urged to avoid the &#8216;Kardashian Kard&#8217;</h2>
<p>Not long ago, a line of prepaid debt cards was announced by the Kardashian sisters. Celebrities sometimes lend their name or likeness to a product because it will sell. That isn&#8217;t so bad; plenty of products that have endorsements that are perfectly fine. However, their card has been slammed, according to <a href="http://money.usnews.com/money/blogs/my-money/2010/11/22/keeping-up-with-the-kardashians-credit-card-.html" rel="external nofollow"><strong>US News and World Reports</strong></a>, as being disgustingly expensive. For instance, every ATM withdrawal from the &#8220;Kardashian Kard&#8221; costs $1.50, on top of ATM fees. It also costs $9.95 to get one, and a monthly fee of $7.95. The &#8220;Kard&#8221; has to have six to 12 months of fees paid to even use it, and it costs $1 every time a person puts money on the account. Basically, a people using the Kard have to give the Kardashians and MasterCard some money now every time they want to use their own payday cash.</p>
<h3>Maybe a payday advance would be better</h3>
<p>A six-month Kardashian Kard costs $59.99, considerably more than the average payday loan costs to borrow. According to the <strong><a href="http://voices.washingtonpost.com/ezra-klein/2010/11/beware_celebutantes_bearing_pr.html" rel="external nofollow">Washington Post</a>, </strong>the normal fee for similar pre-paid debit cards is $10 per year. Though a prepaid card like the Kardashian Kard or the Green Dot Card may not carry as many fees as some bank accounts, it seems ridiculous to be giving up that much from pay day for use of a debit card. It is better to get a checking account through a credit union, as credit unions have far fewer fees than traditional banks. They also don&#8217;t have as many account fees, and credit unions benefit the community, not wealthy celebrities and shareholders who pocket the proceeds.</p>
<h3>Better options</h3>
<p>If you need a small loan until payday, getting a loan from a payday lender may be better than getting one of these celebrity debit cards. <p>Many critics of the payday advance industry have opined that the industry needs greater regulatory control. Numerous states have put interest rate caps, effectively price ceilings, in place which make it hard for loan lenders to make a living. How many payday loans a person can borrow has also been limited by statutes. The calls for new laws rarely address how much self-regulation the industry already does.</p>
<h2>Case for regulating payday advance loans</h2>
<p>There have been numerous campaigns and calls for the payday advance loans industry to be regulated. Some people want cash advances as a product regulated completely out of business. To be fair, there are &#8220;bad apples&#8221; in the industry. In fact, a debt collector for a payday loan lending outfit in Oklahoma is being sued for violating the Fair Debt Collection Practices Act by impersonating a government official, according to <strong><a href="http://www.consumeraffairs.com/news04/2010/11/oklahoma-debt-collector-charged-with-fraud-in-texas.html" rel="external nofollow">Consumer Affairs</a>.</strong> It would seem that there should be strong laws set in place against short term loan lenders so that they cannot abuse people with impunity. However, the payday advance industry has been self-regulating itself for years.</p>
<h3>Best Practices</h3>
<p>There are trade organizations to which payday loan lenders belong at local, state and national levels. Many of these organizations set a code of ethics for themselves, known as Best Practices. The Best Practices are often similar if not the same across trade organizations. For instance, there is disclosing rates and fees up front to customers. Practices also will limit the number of &#8220;roll overs,&#8221; or renewal of loans to customers if there is a pattern of repeat borrowing. They also mandate adherence to the law regarding collections, and encourage customers to report lenders not in compliance with Best Practices to both the organization a lender belongs to, and also to authorities.</p>
<h3>Look for membership</h3>
<p>A potential payday advance loan customer should check out a prospective lender, and see if they are affiliated with any such organization. There should be a seal of membership in a payday loan store or on a website. Look for members of the Online Lenders Alliance, Community Financial Service Association of America or Financial Service Centers of America. This case has been argued, citing the near uniformity of the price of the typical payday advance. However, those who make these claims have clearly not done their homework.</p>
<h2>Fiction of non-competing payday advance lenders</h2>
<p>One of the constant criticisms of the payday advance industry is that lenders do not compete for prices. The Consumer Federation of America asserted in a study that payday lenders, if not put under a vigorous rate cap, will charge the maximum amount allowable. The study in question looks at prices charged on cash advance loans in Colorado, which has a rate cap on the fees that can be charged. However, that study does not address why payday loan fees are so close to the legal maximum.</p>
<h3>Price ceilings</h3>
<p>Most states that allow payday loan lenders to offer payday advances to borrowers also impose a cap on rates and fees. Typically, the cap imposed on loan lenders is between $15 to $20 on every $100 loaned, which is called a price ceiling. The idea is that this keeps prices from being too exorbitant. However, price ceilings that are too close to the break-even point, where no money is lost, ensure that a business has to charge close to the ceiling in order to barely make a profit, never mind keep the doors open. Not only that, but a price ceiling that is too low, according to <a href="http://en.wikipedia.org/wiki/Price_ceiling" rel="external nofollow">Wikipedia</a>, also ensures the black market will enter the picture.</p>
<h3>Someone skipped Econ</h3>

<p>It might seem inconceivable that Americans could save money by borrowing a payday loan sometimes. Industry critics usually have good intentions. However, something often goes unmentioned while the cash advance industry is raked over the coals. If an average person gets a payday loan to keep from going into overdraft, that person saves money.</p>
<h2>An overdraft works like a payday loan</h2>
<p>An overdraft charge works sort of similarly to payday loan, in a way. A certain amount of money is loaned, by a bank, and then a fee is assessed for lending the funds to cover a transactions. Basically, an overdraft is the same thing as a short term loan from a bank. The difference is, no one really wants to overdraft, and a lot of people do it accidentally. Thus, when a people overdraw their accounts, they aren&#8217;t usually choosing or deciding on the amount they want to borrow. And it adds up fast because if customers make multiple overdraft charges, the overdraft fee is charged each time. Overdraft fees from Bank of America and Wells Fargo are $35 per occurrence. It has been estimated that up to 60.4 percent of income for credit unions is from overdraft fee revenues, and more than 43 percent of non-interest income and 21 percent of net operating income for banks. That&#8217;s an awful lot of instant cash.</p>
<h3>Overdrafts add up</h3>
<p>A study published by Bretton Woods Inc. in 2010 reported that the average household with an active checking account incurred 12.7 overdraft fees or non-sufficient fund fees in 2009, which marked an increase from the 11.8 NSF/OD fees in 2008. The average NSF/OD fee, from the same study, was $29.58 in 2009, meaning that at 2009 rates, the average household with an active checking account pays $375.67 or more in OD/NSF fees annually. The average payday loan is $350, and the average fee is $47.50. Because multiple overdrafts can occur easily, and fees are charged per occurrence, it is cheaper to get a payday advance than an overdraft.</p>
<h3>Banks are institutions</h3>
<p>Why do banks get off the hook for these fees? Well, it&#8217;s simple. Banks are institutions, and some people think that institutions should never be held accountable because they are institutions. <h2>The poorest of the poor cannot get a payday loan</h2>
<p>The thing about the people who actually do borrow money from payday lenders, be it from a payday loan store or online payday loan lender, is that they are not the poorest and most desperate. First of all, one has to have a coming pay day to even be considered for a payday loan. One also has to have a checking account. Now, when it comes to banking, there are two designated people that don&#8217;t use a bank for every need. There are the &#8220;unbanked,&#8221; and the &#8220;under banked.&#8221; The FDIC and the Federal Reserve define the “under banked” as people who have a transaction account (e.g. checking or savings accounts) but still utilize alternative financial services (AFS) in order to obtain the products they need.</p>

<p>It is almost impossible to prove that such a thing exists as a payday loan debt trap. Like many social issues, the truth is a lot more complex than many would like to admit. For instance, it is true that a lot of people who borrow money from payday lenders take out multiple loans. However, it has not ever been proven that people are taking out new loans to cover their old ones, which is called a rollover.</p>
<h2>The debt trap myth</h2>
<p>The contention that payday loans trap a person into an endless cycle of debt has never been proved. However, a 2005 study found that many payday borrowers indeed did borrow money multiple times per year. One study found that 29.6 percent of payday borrowers surveyed had 14 or more loans in the previous calendar year and 9.9 percent took out two or fewer, but 28.1 percent had no renewals or rollovers. However, no study has ever ascertained why chronic borrowers, less than half of all payday loan store customers, borrow money with such frequency.</p>

<p>Over the past few years, the term &#8220;predatory lending&#8221; has been brought up a lot, and the term is often leveled at payday lenders. The payday lending industry has been called just about every name in the book. These accusations are inaccurate. Furthermore, it isn&#8217;t fair to level these terms at the typical short term loan lender. In fact, it is hard to call any lending institution a &#8220;predatory lender.&#8221; The reason is that no one really knows what that phrase means.</p>
<h2>Predatory lending didn&#8217;t exist until 1994</h2>
<p>In the wake of the mortgage crisis, there has been great outrage at &#8220;predatory lending,&#8221; a buzzword of the last two decades. According to Adair Morse and others who have studied whether payday lending is predatory, the term was first coined in 1994, and rarely used until at least 2000, and didn’t gain prominence in the national lexicon until after 2005. The phrase, like others, are conjecture at best. A small loan lender is no more a predatory lender than a mortgage company.</p>
<h3>The spread of buzzwords</h3>
<p>There is a social phenomenon known as &#8220;buzzwords.&#8221; Some of them are tied to legitimate concepts, but any buzzword should be viewed with a skeptical eye. Many of them have differing meanings and fuzzy logic. The term &#8220;predatory lending&#8221; would presume that a loan was lent to a person who was desperate, couldn&#8217;t understand the terms, or couldn&#8217;t really pay it back. Since the typical payday advance lender explains terms well, and can&#8217;t afford to lend to people who can&#8217;t pay the loan back, that standard can&#8217;t really be applied. However, that is only a subjective definition. Someone else could think something else entirely.</p>
<h3>Who is really predatory</h3>
<p>Think of the debt burdens many think of as &#8220;good.&#8221; A new car costs almost $20,000. A new house costs over $150,000. <h2>Hard to profit from a cash advance</h2>
<p>Some assume lenders charging the fees they do would lead to outrageous profits. This is not necessarily the case. There was a study done by the auditing firm Ernst and Young of all the payday advance lenders that belong to the Financial Service Centers of America, a business organization of financial service providers. The Ernst and Young study found that for every $15.26 in fee revenue, only $1.22 was actually realized as profit, which is a profit of less than 10 percent. The average small loan from a cash advance lender is between $300 and $400, and the average fee is between $15 to $20.</p>
<h3>Par for the course</h3>
<p>Studies have been done on the payday lending industry for years. A lot of them have found a similar theme. A Fordham Law Journal study by Aaron Huckstep found that the profit margin among the payday lenders surveyed was less than 8 percent. Other studies of profitability put the profits of the largest of payday lenders (such as Advance America, EZCORP and QC Holdings) at 10 percent. A profit of merely 10 percent would certainly not support the surmised stereotype of payday store operators making money hand over fist, like vultures picking clean the bleaching bones of the poor.</p>
<h3>Simple economics</h3>
<p>Some states impose caps on fees. Rate caps are price ceilings. In order to break even or turn a modest profit, lenders have to come close to if not charge right at the cap. Since a $15 fee means just more than $1 of profit, a lender has to charge the legal maximum just to keep their doors open. Payday loans, and everything about them, are so different from loans for cars or houses that putting them in the same category as longterm loans makes little sense.</p>

These types of short-term financial relief are available in so many ways because there is a big market for them. While the market creates the environment for financial options like payday cash advances, it also determines the interest rates associated with these products.</p>
<h3>Payday loans: value vs. price</h3>
<p>Payday loans are like any product or service traded in a <a title="Wikipedia" href="http://en.wikipedia.org/wiki/Free_market" rel="external nofollow">free and open market</a>.
