While payday lenders and their customers have known for years that <strong>taking out a payday loan is cheaper than overdrawing your bank account</strong>, this study calls attention to this fact.</p>
<h3>Fee comparison</h3>
<p><a title="Read article" href="http://www.bloggernews.net/120218"  rel="external">Lawrence Meyers</a> from Blogger News Network shares an example of what this report shows. He reports that the average amount obtained when bank customers overdraw their accounts is $60. The average overdraft fee? $27. Nationally, the average fee for a $60 payday loan is about $6.</p>
<p>Most banks charge an <strong>overdraft fee</strong> each time you make a charge on an overdrawn account. So if you use your debit card to buy a cup of coffee when your account is already overdrawn, add the overdraft fee and you&#8217;ve got yourself a $30 coffee.</p>
<h3>Selective regulation</h3>
<p>Meyers also points out that legislators all over the country are calling for restrictions to be placed on payday loan companies. Lawmakers call payday lenders fees &#8220;outrageous&#8221; and rant about &#8220;ridiculous APRs.&#8221; However, Meyers notes, no one bats an eyelash when a bank charges $27 for a $1 loan.</p>
<blockquote><p>The data is astonishing, and unequivocally demonstrates that as consumer activists and grandstanding politicians rake payday lenders over the coals, they ignore the bloodsucking that occurs every time a consumer bounces a check, Meyers writes.</p></blockquote>
<h3>Report encourages responsible usage</h3>

<p>The great thing about this FDIC report is that it emphasizes one of the best uses for payday loans: to save money. If you know you are going to overdraw your account, and you can get a payday loan for $15 instead of paying a $27 overdraft fee it makes perfect sense. That is an excellent and responsible use of a payday loan.</p>
<h3>Payday lending regulations hurt</h3>
<p>It&#8217;s a bit shocking to read the reports accounting of bank overdraft fees in areas where payday loans aren&#8217;t available.</p>
<blockquote><p>In states where payday loans were forced to shut down by &#8230; legislators, the average annual amount of NSF fees charged to consumers was just under $541. In states where payday loans are permitted, that amount is only $240, Meyers writes.</p></blockquote>
<p>Certainly makes you think.</p>

Now it is time to rejoice. A giant will have to pay for their misdeeds.</p>
<p>A <a href="http://clossonsettlement.com/"  title="recent class action" rel="external">recent <strong>class action</strong></a> heard in California Superior Court based on &#8220;allegations of misconduct relating in part to its assessment of certain fees in relation to debit card transactions&#8221; will result in a <strong>settlement</strong> payment by <strong>Bank of America</strong>. The Settlement Fund will receive $35 million from the banking giant, to be divided amongst members of the action.</p>
<p>The lawsuit claims <strong>BofA</strong> &#8220;encouraged its customers to use Bank of America <strong>debit cards</strong> and increased the number of fees charged to customers using Bank of America debit cards through the order in which such transactions are posted and the account balance information it provides.&#8221;</p>
<h3>Unconscionable</h3>
<p>The lawsuit also claims that Bank of America &#8220;authorizes debit card transactions that will result in overdraft fees; fails to warn customers that specific debit card transactions may result in <strong>overdrawn accounts</strong>; posts debit card and other transactions in high-to-low order; and provides account balance information to customers that is not current, accurate or as advertised.&#8221; In addition, the lawsuit claims that Bank of America&#8217;s customer agreements are &#8220;unconscionable, and that Bank of America does not provide customers with copies of <strong>account agreements</strong> until after they open their accounts.&#8221;</p>
<p><em><strong>Payday loans</strong></em> include much less hassle.</p>
<p>Bank of America denies these claims and contends that its actions have been in accordance with state and federal laws and its customer agreements. Even though BofA admits no wrongdoing in the settlement, it is clear outside the rigid constraints of court that they&#8217;re guilty.</p>
<h3>Other banks in on the skullduggery</h3>
<p>According to the settlement record, customers of Fleet Bank, LaSalle Bank, LaSalle Bank Midwest, and U.S. Trust Company may also be Settlement Class Members. This absence of competition will hurt consumers.</p>
<p>A <a href="http://www.springerlink.com/content/7v05228739445p81/"  title="recent study" rel="external">recent study</a> by East Carolina University economist Mark A. Fusaro showed that regular checking overdraft is ridiculously expensive</p>
<blockquote><p>A person who has a $3 overdraft that is outstanding for one day pays an implicit interest rate of 260,245 percent.</p></blockquote>
<p>Interestingly, banks play an important part in the creation of <strong>payday loans</strong>. The <a href="http://www.pbs.org/wgbh/theymadeamerica/filmmore/s2_pt.html"  title="Bank of Italy" rel="external">Bank of Italy</a> opened in San Francisco to serve those who went unserved by larger banks. Ironically, this upstart company went on to become Bank of America, one of many megabanks that oppose to competition <strong>no fax payday loan</strong> companies offer them.</p>
<h2>This is why consumers turn to <em><strong>payday loans</strong></em></h2>
<p><img class="alignright" src="http://upload.wikimedia.org/wikipedia/en/thumb/3/33/Nhline.jpg/202px-Nhline.jpg" alt="" width="163" height="122"  style="display:block;float:right;"/>Since banks no longer offer small-scale consumer loans &#8211; let&#8217;s say $100 or $200 to prop up your budget during a cash emergency before payday &#8211; <strong>payday loan</strong> companies have provided the service. As they have been successful in this endeavor &#8211; Kennedy notes the recent Community Financial Service Association (CFSA) estimate that there are about 22,000 payday loan stores in the U.S. &#8211; banks have been keen to step back in and reclaim the business that they once believed wasn&#8217;t &#8220;good for business.&#8221;</p>
<p>The <strong>impact of legislation</strong> catering to banks&#8217; desires for profit will be devastating. Payday loan companies will be forced to close once unreasonable rate caps are in place.<strong> People will lose jobs</strong>, consumers will look to other less-regulated sources for short-term cash assistance and the economy as a whole will suffer thanks to a lack of competition in the market. Banks will then have no incentive to offer better products or <a href="http://personalmoneystore.com/moneyblog/2008/12/05/fdic-overdraft-payday-loans/" title="curb extortionist overdraft fees">curb extortionist overdraft fees</a>.</p>
<h2>The Federal Reserve is on the side of <em><strong>payday loans</strong></em></h2>
<p>Is not the Federal Reserve a national money authority in America? They have released reports that not only show that no fax payday loans <a href="http://www.newyorkfed.org/research/staff_reports/sr273.html"  title="fail to meet the definition" rel="external">fail to meet the definition</a> of &#8220;predatory lending,&#8221; but that when states ban <strong>payday loans</strong> as New Hampshire is headed toward, there are mostly negative effects. Studies from academia <a title="(see Sept. 2008 paper)" href="http://www.dartmouth.edu/~jzinman/Papers/"  rel="external">like this</a> further corroborate this point.</p>
<p>Ms. Kennedy&#8217;s ideas could be very effective at addressing this problem. First, she suggests that exorbitant fees be curbed. She believes that banks should return to an old practice where there was a <strong>minimum dollar </strong>amount necessary to <strong>trigger overdraft fees</strong>. It was not uncommon that if a customer <strong>overdrafted</strong> less than $15, fees would not be charged. In addition, she believes New Hampshire offer more <strong>affordable health care</strong> and give raises that keep pace with inflation. She also feels that making basic financial life skills a part of regular school curriculum will help immensely. <strong>Payday loans</strong> aren&#8217;t the problem, but the competition they afford is part of the solution.</p>

<p>This year however is going to be a little different as many are waking up to find that their lines of credit have been reduced.  Some are finding there is nothing left on their cards but the balance owed.  These actions are obviously a knee jerk reaction to  this years fallout with some of the nations largest banks, the bailout, the nations credit crunch.</p>
<h3>Feeling Short Changed? Don&#8217;t!</h3>
<p>A lot of controversy surrounding these latest events as citizens are feeling they have been short changed.  Are the banks operating in the best interest of it&#8217;s customers?  Well, I guess that depends on how we look at it.  True, we may not get the kiddies what they have been asking for all year, yet we won&#8217;t be stuck making extra monthly credit card payments through June of next year either or using <strong>no fax payday loans</strong> to make ends meet.</p>
<h3>What About the Kids</h3>
<p>Perhaps this years festivities would be an opportune time for families to come together simply  to enjoy each other, something that our gift hungry starry eyed children often forget.   For myself It&#8217;s going to take some improvising but I aim to make it memorable as always for both myself and my kids.  The children however may remember this year as the year that they didn&#8217;t get what they wanted and the reasons why.  In all reality, this lesson on life is probably the best gift  I could give them.</p>

<p>This raises questions in my mind in regards to the proposed overdraft ruling.  My bank made it very known to me upon opening a checking account,  what the consequences would be of over drafting it.  They strongly advised against it and explained to me the consequences that were set in place.</p>

<p>Sparked by <a title="Office of Fair Trading UK" href="http://www.oft.gov.uk/"  rel="external">Office of Fair Trading</a> investigation of the English banking industry and their overdraft practices, an anonymous former bank employee was charged with mapping out exactly what a customer&#8217;s overdraft would cost a bank. Using a simple spreadsheet, calculations were done to show how long a clerk would need to:</p>

<li>look at the daily report of overdrawn accounts</li>
<li>decide an account needed to be referred to head office</li>
<li>check the account transactions</li>
<li>manually change the account to reflect the bounced check</li>
<li>put the information into a computer</li>

<p>Bank overdraft fees, the charges which results from overdrawing your checking account have been fueling a hot debate everywhere as people argue that the banks need to be regulated.  This comes in response to many outraged consumers who feel the banks are intent in trapping there customers into paying steep fee&#8217;s and penalties for small and seemingly forgivable mistakes.</p>
<h3>The Big Question</h3>
<p>The big question is whether this is simply the result of irresponsible financial management on the part of the customer or predatory practices on behalf of the banks.  After all, customers wouldn&#8217;t be fined if their the accounts weren&#8217;t overdrawn. The process however, by which accounts are getting overdrawn is what is raising red flags among consumers and resulting in more of them taking out <strong>payday loans</strong> to cover the cost of possibly unnecessary overdraft fees.</p>
<p>For example, one customers online banking transaction failed to go through, leaving them with several overdraft charges before the mistake was brought to their attention. <h3>My Own Opinion</h3>
<p>I would tend to agree with a little of both sides.  If you choose to have a checking account you are obligated to maintain it.  Falling outside of these terms is a failure on the customers part, but the customer can easily fix their mistake with the help of <strong>payday loans</strong>.  That being said though, I think banks need to exercise a little more courtesy when it comes to things like overdrafts and ATM fees.  If a customer bounces a check leaving them with a heap of overdraft fees, I don&#8217;t think tacking additional daily fees for each day the account is left with a negative balance is good customer service, nor is it helping the customer recover from their mistakes.</p>
<p>Hopefully the end to all this will see both the customer exercise greater financial responsibility and the bank more customer courtesy. <p>Overdraft rates have become a popular topic in the news lately in regards to their continual rising of overdraft fees among others.
